Meeting Minutes

 

April 5, 2010

 

The regular monthly meeting was called to order 6:35 pm by Chairman Walter Botsford. A motion was made by Kevin Botsford, seconded by Richard Marks and agreed to by Walter Botsford to accept the treasurer's report.

 

The minutes were presented. Correction to the minutes. Tar and Chip bids, it should state, a motion was made by Kevin Botsford, seconded by Richard Marks and agreed to by Walter Botsford to accept the bid from Keystone Paving and Materials. A motion was made by Kevin Botsford, seconded by Richard Marks and agreed to by Walter Botsford to accept the minutes with corrections.  

 

A motion was made by Richard Marks, seconded by Kevin Botsford and agreed to by Walter Botsford to approve the agenda.

Old Business:

Convention:  PSATS convention will be held April 18-21. Walter Botsford, Richard Marks and Kelly Glinski will be attending the convention. Walter Botsford will drive, and all will carpool together.

New Business:

 

Resolution # 2010-02  states the township will adopt the schedules and procedures for disposition of records as set forth in the Municipal Records Manual. Kevin Botsford made motion, Richard Marks seconded, and Walter Botsford agreed to adopt Resolution 2010-02.

 

Resolution # 2010-03 declares the township's intent to follow the schedules and procedures for the disposition of records as set forth in the Municipal Records Manual as adopted in Resolution 2010-02. Specific dates and records have been stated in the resolution. Kevin Botsford made a motion, Richard Marks seconded and Walter Botsford agrees to adopt Resolution #2010-03.

 

Auditors Report and Comments The auditors completed the audit for 2009. They submitted recommendations to the supervisors. The recommendations were read, and supervisors have considered the recommendations.

Dumpsters Kevin Botsford made a motion, Richard Marks seconded the motion and Walter Botsford agreed to purchase two new dumpsters.

 

Liquid Fuel Turnback Money Turnback money was received and deposited $4,720.00 into the state fund account on April 1, 2010.

Stone Bids
One bid was received from Dushore Construction. For 3,000 tons of 2RC stone FOB 6.00/ton Unit price delivered at jobsite 9.39/ton TOTAL 28,170.00. A motion was made by Kevin Botsford and seconded by Richard Marks and agreed to by Walter Botsford to accept the stone bid from Dushore Construction.

Tar and Chip Bids
One bid was received from Keystone Paving and Material for tar and chip selected roads throughout the township. Total amount for the bid for single and double coat application is $22,565.15

Bud North, Muncy Valley Watershed Association. He was inquiring about the Township's Flood Plan ordinance. Due to the recent flood and damage to flood areas, he wanted to insure we are not only protecting ourselves but the environment and the watershed.

Dumpster
The dumpster has been purchased and delivered to township. It is ready to use.

New Business:

Stone Bids:
A motion was made by Kevin Botsford and second by Richard Marks and agreed to by Walter Botsford to advertise for stone bids for 2010. Bids will be open on March 1, 2010 at 6:45.

Tar and Chip Bids:
A motion was made by Kevin Botsford, seconded by Richard Marks and agreed to by Walter Botsford to advertise for Tar and Chip bids for the year 2010. Bids will be opened March 1, 2010 at approximately 6:45 p.m.

Flood Storm Damage:
Progress is being made to get township roads back to usable condition following flood which occurred January 25, 2010. There is approximately $35,000 in damages. Pictures and documents have been submitted to Sullivan County Emergency Services for possible state and/or federal funding.

January 4, 2010

The Re-Organizational meeting of the Laporte Township Supervisors was held on Monday January 4, 2010 at the Laporte Township Municipal building. Supervisors Walter Botsford, Richard Marks and Kevin Botsford were present.

After a motion by Richard Marks and seconded by Kevin Botsford, Walter Botsford and Kelly Glinski were named as temporary Chairman and secretary for this meeting.

The meeting was called to order at 12:00 p.m.

Wages
A motion was made by Richard Marks and seconded by Kevin Botsford and agreed by Walter Botsford, Transfer station wages increased by $0.25, laborer increased by $0.25 and secretary wage was set at $475.00 per month.

Wages are as follows:
Secretary/Treasurer $475.00 per month
Transfer Station attendants $9.75 per hour with the following holidays New Years Day, Easter, Thanksgiving and Christmas, if holiday falls on a normal scheduled work day.
Laborer $10.50 per hour
Operators/Laborer $10.50 per hour
Supervisors This is set by auditors
Mileage Is set at the State rate


Treasurers Bond
A motion was made by Richard Marks, seconded by Kevin Botsford and agreed to by Walter Bostford to keep the treasurer's bond at $100,000.00.

Budget 2010 A motion was made by Richard Marks, Seconded by Kevin Botsford and agreed to by Walter Botsford to adopt the 2010 Budget.

Stimulus Road Project Shaffer Rd. There is a delay in the work to be started. Work on the road should start in spring 2010.

Pole Bride Road: A motion was made by Kevin Botsford, seconded by Richard Marks and agreed to by Walter Botsford to accept $2500.00 in escrow to be used to bring Pole Bridge up to township standards and approval with intention to take over Pole Bridge Rd. and maintenance of road in good faith until road is adopted by township.

New Truck: Richard Marks took delivery of the new Ford 550 dump truck. The truck is working well and meeting up to the standards of the supervisors.

Re-Organizational Meeting The re-organizational meeting will be held on January 4, 2010 at 12:00 pm. The regular monthly meeting will follow. Public notice will be sent to the Sullivan Review.

Dumpsters: Still waiting on Northern Tier Solid Waste to repair dumpster. Richard Marks stated the price of dumpsters have come down in the past few months. The price is $3975.00 for a dumpster

County Aid: MS 999 was signed and sealed for county aid for the engineering study done on the roads.

Laporte and Davison Bridge: Report was read on the bridge. No work is needed to the bridge at this time.

Brett Feese: Brett Feese was contacted by Kelly Glinski, Secretary, to see if he is available to be the solicitor for 2010. He stated he would be available to represent the township.

Old Business:

Budget 2010 The budget for fiscal year 2010 has been prepared and will be advertised for public inspection. The budget will be adopted at our December 7, 2009 meeting

Stimulus Road Project Shaffer Rd. Work has not yet begun on the project. Waiting to hear for date to start work.

COG Meeting Supervisor Walter Botsford reported on COG meeting. Next COG meeting will be held November 17, 2009.

Joe Pasanchin: Township received a letter from O'Malley and Langan on behalf of Joe Pasanchin of a potential claim.

Truck: new will be ready by the end of the week. Supervisors authorize Richard Marks to take delivery of the truck.

Pole Bridge Supervisors are waiting on complete paperwork for deed and right away to claim Pole Bridge Road.

Security Cameras Two security cameras have been purchased and installed at the Township building.

New Business:

Millage Resolution
A motion was made by Richard Marks, and second by Kevin Botsford and agreed by Walter Botsford to adopt resolution #08-2009 setting the 2010 tax millage rate at .65. There was no increase from last year.

County Aid MS - 339 application has been completed for county aid for the traffic study.

Road Patch: A motion was made by Kevin Botsford, seconded by Richard Marks and agreed to by Walter Botsford for road patch and crack sealing for Old 220, Gavitt Rd and Little Rd by Keystone Paving for $4,835.00.

Old Business:

Security Cameras Supervisor Marks looked into purchasing security cameras for Township building and transfer station. He is waiting on more information about cameras and pricing.

Stimulus Road Project Shaffer Rd. Bids were opened and work is scheduled to start October 19, 2009.

Front Lot Tar and chip has been completed at township building. Estimate cost is $7750.00. Approval for funding from county handicap improvement fund is approximately $2100.00.

COG Meeting: Supervisor Walter Botsford and Richard Marks reported on COG meeting. The meeting discussed road agreements and post and bonding roads due to gas companies in the area.

New Business:

Budget: Supervisors reviewed 2009 budget. Work has begun on 2010 budget.

Tom Kitchen - Lakewood: Approval has been given to Tom Kitchen to add Lot B to Lot 13 at Lakewood.

Truck Bid Ad: Supervisors agreed to place ad in Township News for bids on 2000 Ford F-550. Bids are receive by December 7, 2009 at 6:30 pm and will be open at 7:00 pm at regular monthly meeting. The ad will also be placed in the Sullivan Review. Pricing for Sun-Gazette and Daily Review are being looked into.

Joe Pasanchin: Supervisors have contacted insurance company about the incident. The insurance company will be handling any investigation on this matter.

The regular monthly meeting of the Laporte Township Supervisors was held Tuesday September 8, 2009 at the Laporte Township Municipal Building.

With Supervisors Botsford, Botsford and Marks present. Chairman Walter Botsford called the meeting to order at 6:30 p.m.

There was one correction to August 3, 2009 meeting minutes. It should read Shaffer and Fairman Road project will be completed by end of July 2010. Motion was made by Kevin Botsford, seconded by Richard Marks and agreed to by Walter Botsford to accept the meeting minutes with the correction stated.

Old Business:

Gentlemen's Club The township solicitor, Brett Feese, was contacted to see what ordinances or action the township could take in regards to a Gentlemen's' Club or alike establishments. Brett Feese submitted a letter to the township with legal advice. The township took no action in this issue.

Stimulus Road Project Bids will be opened on September 11, 2009. It will be awarded on Oct 1, 2009. Work is to be Oct 2, 2009. Completion date is end of July 2010.

Sullivan County Council of Township Officials Dinner and meeting will be held October 6, 2009 at the Muncy Valley Fire Hall. RSVP will be sent for 4 people from Laporte Township. Richard Marks, Kevin Botsford, Walter Botsford and Kelly Glinski.

Truck Prices
Bradco/Hondru $74,233.09 (truck and box) Sunbury Ford/Maxwell Trucking $63,977.00(truck and box) Motion was made by Kevin Botsford, seconded by Richard Marks and agreed to by Walter Botsford to accepted quoted price from Sunbury Ford.

Snowplowing Richard Marks met with Davidson Township and both agreed with the following for snowplowing. On odd years, starting 2009- 2010 Laporte Township will plow, all of Old 220 and Fairman Road out to Shaffer Rd. On even years, Laporte Township will plow Shaffer and Fairman Road loop.

New Business:

Security Camera: Motion by Kevin Botsford, seconded by Richard Marks and agreed to by Walter Botsford to purchase security camera system with a budget of $1500.00

Front Lot: Motion was made by Richard Marks, seconded by Kevin Botsford and agreed to Walter Botsford to start project of tar and chipping the front lot and in front of cinder shed. Work is to be done by Keystone Paving for $7500.00-$8000.00 with hopes of partial payment from handicap grant fund.

Road Inspections: Supervisors reviewed the report of road inspections findings of Bassett Engineering.

Road Detour Work will be done on High Bridge on SR 2002 starting April 2010. Detour will be in place for approximately 5 months until bridge decking is replaced.

COG Meeting: The next COG meeting will be held September 22, 2009. The meeting will discuss road bonding and road maintenance agreement with gas companies. Walter Botsbord and Richard Marks will be in attendance of this meeting.

NIMS Kelly Glinski has completed NIMS 700.a course. Certificate is on file in township building.

The regular monthly meeting of the Laporte Township Supervisors was held Monday August 3, 2009 at the Laporte Township Municipal Building.

Old Business:

Shaffer and Fairman Road Richard Marks updated the status of the dirt and gravel project. The project was approved for stimulus money. The project will be completed end of August.

Pole Bridge Subdivision Kevin Botsford made a motion, Richard marks seconded the motion and Walter Botsford agrees to resolution # 07-2009 for the Pole Bridge subdivision.

New Business:

Gentlemens Club: there was a discussion on an ordinance which would effect gentlemen's club and alike establishments. The township will contact solicitor for information about such ordinance.

Lost Lake: The problem with Lynn Myers was resolved with no action taken.

Snow Plowing with Davidson Township There was a discussion about sharing snow plowing with Davidson Township. The roads which cross over township lines and would be considered for snow plow sharing are Fairman, Shaffer and Old Rt 220. Supervisors will talk to Davidson Township Supervisor to see if there is a compromise for snow plow sharing.

New Truck Information from Hondru Ford was shared about a new Ford 550. There was a discussion about purchasing a new truck. No decision was made, seeking more prices from another dealer.

Right to Know There was a Right to Know request from J. Howard Langdon representing Michelle Mahoney and Joseph Liccese. The request was asking for documents stating a private road was ever a public road. No records were found stating the road was ever a public road. Secretary will send a letter in response stating no records were found.

Emergency Management Coordinator Supervisors are seeking a person to fill the position of emergency Management Coordinator. Job qualifications and job description was discussed. No person was appointed to the position at this time.

County Convention: The Sullivan County Association of Township Supervisors will hold their annual convention on Oct 6, 2009 at the Muncy Valley Fire Hall. Those who are attending will have to requester at the next meeting.

One bid was received from Dushore Construction Materials. For 3,000 tons of 2RC stone FOB 6.00/ton Unit price delivered at jobsite 9.39/ton TOTAL 28,170.00. New Business:

Illegal Bridge : Richard Rasmussen Jr, was notified by Supervisor Richard Marks that he was constructing an illegal bridge across a creek on his lot He was informed to halt construction until proper permits have been issued. His lot is located off of Christian Camp Rd. DEP has been notified of his actions.

Act 32 Consolidation of Earned Income Tax:. A delegate is to be appointed to Tax Collection Committee and submitted to county commissioners by June 22, 2009. This has been tabled until next meeting.

Disposition of Records: The supervisors tabled this topic until next meeting to allow time to review the ordinance regarding disposition of records.

Donation to Laporte Fire Company: A motion was made by Kevin Botsford, seconded by Richard Marks and agreed by Walter Botsford to make a donation of $1,000.00 to the Laporte Volunteer Fire Company.

Payroll Policy Payroll policy was review. Auditors gave $0.40 raise to supervisors making their hourly wage $13.90. Payroll is paid on the 15th of the month and the last day of the month.

Budget The budget for fiscal year 2009 has been prepared and will be advertised for public inspection. The budget will be adopted at our December 1, 2008 meeting. The new attendance booth for the transfer station has been complete.

Millage Resolution A motion was made by Kevin Botsford, and second by Richard Marks and agreed by Walter Botsford to adopt resolution #01-2008 setting the 2009 tax millage rate at .65. There was no increase from last year.

Summit Seminar Walter Botsford and Richard Marks will be attending the Pennsylvania Natural Gas Summit Seminar on December 10-11, 2008. The seminar will be held in State College, PA.

At 6:55 p.m. Chairman Walter Botsford temporarily recessed the regular meeting to convene a public hearing to take testimony concerning whether or not the ordinance should be adopted to vacate T-339 a/k/a Tilley Road.

First to speak was Rodney Bower (son in law of Mr. and Mrs. Donald Benson), if the road is abolished will it go back to the land owners? Attorney Feese said the road would go back to the land owners. The township is vacating the road to no longer maintain it. Mr. Bower stated that the objection was not having township road access would lesson the value of the land. Once vacated the township no longer maintains the road.

George Windolph said that if the road is vacated it is up to the private owners to maintain it.

Robert Zuber asked if we would be grading it back to the original grade-then there would be no road. Walter Botsford said that is what we are proposing, but would be flexible on where we would start that.

Violet Miller then said why are we having a discussion about closing the road when it sounds like it is a done deal. Chairman Walter Botsford responded by the road is rarely used and it is a high maintenance road and we could spend township funds other places. Ms. Miller said she would like to see the road open for another way off the mountain.

John Peterman, Jr. objected to the road being closed because we have a lot of 60 year old or older persons in the county who like to walk, drive, ride bicycles. He thinks we are taking away from these people. He wants to see the road maintained as a low maintenance road.

George Windoph wanted to let everyone know that he has no problem with the landowners or other people walking up and down the road. Mr. Windolph told a story about the road and would like to see it vacated.

Mr. Zuber then asked how much liquid fuels money would we lose by closing the road. The supervisors were not sure of the exact amount, but know it is not very much. Supervisors Marks stated that if we put the road back to its original grade we would be getting grant money for the cost involved.

Mrs. Benson stated that if the township put the road back to its original grade they wouldn't be able to get into the cut. The supervisors told Mrs. Benson that they could be flexible where they start.

Mrs. Zuber stated that there is a real problem with ATV's on the road. They are a real nuisance.

Violet Miller said the road can not be closed because Muncy Creek Floods a lot.

Mr. Zuber asked if a gate could be put across and the property owners have keys to it. If the township still owns the road no gates can go in place. If the road is vacated the property owners could put a gate up.

Mr. windolph said it is a hard road to walk because you are going up hill. It is approx. ½ mile of road and it is generous to say 1 car per day might drive on the road.

Randy Reibson spoke on behalf of Dirt & Gravel roads that Tilley Road is always going to be a road that you have to keep putting a lot of money into. From Randy's point of view if this road is vacated the township won't waste money and the environmental impact will be gone.

Mr. Zuber then asked what happens if the road is abandoned and just left and water runs down. Walter Bots ford told him it would be the land owners responsibility to make the necessary repairs.

The question was then raised as to why the property owners do not have to go to court for the road to be closed. Attorney Feese answered because the second class township code allows for this procedure

At 7:37 p.m. Chairman Walter Botsford recessed the public hearing and reconvened the regular monthly meeting.

Tilley Road:

After some discussion the supervisors agreed to just vacating the road. They will not have it returned to its original grade. This motion was made by Kevin Botsford, seconded by Richard Marks and agreed to by Walter Botsford to adopt ordinance #2008-01 "An ordinance of the township of Laporte, Sullivan County, Pennsylvania, vacating a portion of T-339, a/k/a Tilley Road".

Supervisor Marks is seeing what we could get for a trade in on our current compactor. We would like to trade it in for a low profile with a disconnected receiver.

Mr. Peterman wanted to let the Supervisors know that he opposes to grinding up the asphalt on Snyder Road. Supervisor Marks explained to Mr. Peterman that Snyder Road is not an asphalt road. It is a road that has been tar & chipped. The road needs to be ground up, the crown removed and rebase it good so that in the future it can be tar & chipped again.

Mr. Peterman and Ms. Miller are still opposing the abandonment of Tilley Road.

Millage Resolution:

With no further business to discuss Chairman Walter Botsford adjourned the meeting at 8:05 p.m. after motions by Richard Marks, seconded by Kevin Botsford and agreed to by Walter Botsford.

The regular monthly meeting of the Laporte Township Supervisors was held Tuesday September 4, 2007 at the Laporte Township Municipal Building.

With Supervisors Botsford, Botsford and Marks present Chairman Walter Botsford called the meeting to order at 6:30 p.m.

After a motion was made by Kevin Botsford, seconded by Richard Marks and agreed to by Walter Botsford the treasurer’s report was accepted. The minutes as presented were approved by motion of Richard Marks, seconded by Kevin Botsford and agreed to by Walter Botsford.

After a motion was made by Richard Marks seconded by Kevin Botsford and agreed to by Walter Botsford the agenda was approved.

Old Business:
Office Equipment:
A new computer, printer, and software were purchased. Northern tier regional planning and development has approved us for the grant to be reimbursed 75% of the purchase price.

Tilley Road:
The supervisors reviewed the survey maps from John Klus. Everything is acceptable, except the beginning point should begin at the western end of the property. The supervisors will meet with Randy Reibson to resolve the work to be completed to vacate the road.

Mack Truck:
Walt and Rich went and physically inspected the 2000 Mack truck and found everything to be satisfactory and we will be purchasing it.

New Business:
Resolution:
A motion was made by Richard Marks, seconded by Kevin Botsford and agreed to by Walter Botsford to adopt resolution #04-2007 NIMS.

A 4-wheeler tore up Little Road.
